GANG CHARGES

California Penal Code § 186.22(a) makes it a substantive offense to actively participate in any criminal
street gang with knowledge that its members engage or have engaged in a pattern of criminal activity,
and to willfully promote, further, or assist in any felonious conduct by members of that gang. 

California Penal Code § 186.22(b) provides for an additional consecutive punishment if a person is
convicted of commiting a felony for the benefit of, at the direction of, or in association with any
criminal street gang, with the specific intent to promote, further, or assist in any criminal conduct by
gang members. 

 
The possible additional sentence under this enhancement is between 2 years to LIFE in state prison depending on the underlying felony conviction. 

Both §§ 186.22(a) and 186.22(b) constitute STRIKES under the California Three Strikes Law
