DRUG CHARGES


The quantity, classification and purpose in possessing a drug generally determines the seriousness of the charges alleged, as well as the ultimate punishment in the event of conviction.  Depending upon the crime(s) for which one is convicted, the punishment may involve such things as a fine, a drug-treatment program, local jail time or a commitment to state prison.     

Common possession "for personal use" charges under California's Health and Safety Codes include the following:

  • Health and Safety Code § 11357(a):  Possession of concentrated cannabis;
  • Health and Safety Code § 11357(b):  Possession of less than an ounce of marijuana;
  • Health and Safety Code § 11364:  Possession of drug paraphernalia;
  • Health and Safety Code § 11377:  Possession of a non-narcotic controlled substance.

Common "manufacturing" and prossession or transportation "for sale" charges under California's Health and Safety Codes include the following:

  • Health and Safety Code § 11351:  Possession of a controlled substance for sale;
  • Health and Safety Code § 11357(b):  Possession of marijuana for sale;
  • Health and Safety Code § 11378:  Possession of a controlled substances for sale;
  • Health and Safety Code § 11378.5:  Possession of PCP for sale;
  • Health and Safety Code § 11379:  Sale or transportation of a non-narcotic controlled substance;
  • Health and Safety Code § 11379.6(a):  Manufacturing a controlled substance;
  • Health and Safety Code § 11379.5(a):  Sale or transportation of PCP.
